Understand the Fideicomiso

The Fideicomiso, commonly referred to as a “Bank Trust,” is a legal construct in Mexico that allows foreigners to own property, even in restricted zones like the beachfront or border areas (specifically any land within 50 kilometers of the coast or 100 kilometers of the border).
The bank acts as a trustee that holds the property deed on your behalf while giving you all the rights of ownership. This means you can sell, lease, or pass the property on to heirs. The fideicomiso has a term of 50 years but can be renewed indefinitely, ensuring that the property can remain in your family for generations to come.
Despite being a bit different from property ownership in other countries, the fideicomiso is a safe and legal way for foreigners to own property in Mexico. If you’re considering buying property in San Jose del Cabo, it’s important to consult with a real estate professional who is familiar with the process and can guide you through it.

Learn the language and find communities

While Spanish is the official language of San Jose del Cabo, the town’s robust tourism industry and established expatriate community ensure English is widely spoken. Learning basic Spanish phrases, however, can significantly enhance your overall living experience.
It’s also important to try to reach out and connect with fellow expats and English-speaking communities. For example, searching for terms like “San Jose del Cabo Expats” or “Expats in Los Cabos” on Facebook, Instagram, or other social media platforms will likely yield results. These groups often organize social events, share local information, and offer support to newcomers.

But don’t limit yourself to Expat or English-speaking communities. As you live in San Jose del Cabo, broaden your horizons and engage with locals for a deeper understanding of the Baja culture and lifestyle.

Check your visa requirements

Finding the perfect home in San Jose del Cabo might require an extended stay in the city or several trips to and from your home country. It’s important to do your research on the different visa types you can apply for, and choose one that can make the home-buying process – and actually living in San Jose del Cabo – much easier.

  • Temporary Visas (Visitante)

    If you’re from a visa-exempt country like the US or Canada, you can enjoy Mexico for up to 6 months as a visitor. No paperwork is involved, simply enter the country and immigration will stamp your passport with your allowed stay duration. A temporary visa, however, doesn’t permit paid work.

    Visitor permits can be valid for up to 180 days, but the exact length of stay is up to the immigration officer’s discretion. They can’t be renewed or extended in Mexico. For a guaranteed 6-month stay, consider applying for a “visitante” visa at a Mexican consulate before your trip. Frequent visa runs (leaving and re-entering every few months) are highly discouraged.

  • Temporary Resident Visas (Residente Temporal)

    This visa is ideal for extended stays (180 days to 4 years) for retirees, investors, or those with job offers. The application process involves paperwork (some in Spanish), an interview at a Mexican consulate in your home country, and finally, registering with Mexican immigration upon arrival.

    The consulate visa is valid for 180 days, so plan your Mexico entry accordingly. Inform immigration you need a “canje” stamp to change your status. You have 30 days to finalize your residency within Mexico. If you plan to work, your employer needs to request a temporary resident visa with a work permit on your behalf.

  • Permanent Residency (Residente Permanente)

    This visa offers indefinite residency in Mexico, which means you can stay as long as you want. The application process is similar to temporary residency but with higher financial requirements unless you’ve already been a temporary resident for four years. Permanent residents enjoy most rights of Mexican citizens (except importing foreign-plated vehicles).

  • Mexican citizenship

    Mexico allows dual citizenship. You can apply after five years of legal permanent residency, or two years if married to a Mexican citizen or with a Mexican-born child. The application process involves a residency history check, basic Spanish skills, and a potential cultural integration test. Citizenship grants you additional rights like buying property in restricted areas and voting.
