The bank acts as a trustee that holds the property deed on your behalf while giving you all the rights of ownership. This means you can sell, lease, or pass the property on to heirs. The fideicomiso has a term of 50 years but can be renewed indefinitely, ensuring that the property can remain in your family for generations to come.
Despite being a bit different from property ownership in other countries, the fideicomiso is a safe and legal way for foreigners to own property in Mexico. If you’re from a visa-exempt country like the US or Canada, you can enjoy Mexico for up to 6 months as a visitor. No paperwork is involved, simply enter the country and immigration will stamp your passport with your allowed stay duration. A temporary visa, however, doesn’t permit paid work.
Visitor permits can be valid for up to 180 days, but the exact length of stay is up to the immigration officer’s discretion. They can’t be renewed or extended in Mexico. For a guaranteed 6-month stay, consider applying for a “visitante” visa at a Mexican consulate before your trip. Frequent visa runs (leaving and re-entering every few months) are highly discouraged.
- Temporary Resident Visas (Residente Temporal)
This visa is ideal for extended stays (180 days to 4 years) for retirees, investors, or those with job offers. The application process involves paperwork (some in Spanish), an interview at a Mexican consulate in your home country, and finally, registering with Mexican immigration upon arrival.
The consulate visa is valid for 180 days, so plan your Mexico entry accordingly. Inform immigration you need a “canje” stamp to change your status. You have 30 days to finalize your residency within Mexico. If you plan to work, your employer needs to request a temporary resident visa with a work permit on your behalf.
- Permanent Residency (Residente Permanente)
This visa offers indefinite residency in Mexico, which means you can stay as long as you want. The application process is similar to temporary residency but with higher financial requirements unless you’ve already been a temporary resident for four years. Permanent residents enjoy most rights of Mexican citizens (except importing foreign-plated vehicles).
- Mexican citizenship
Mexico allows dual citizenship. You can apply after five years of legal permanent residency, or two years if married to a Mexican citizen or with a Mexican-born child.
